INTELLECTUAL RIGHTS AND USAGE POLICY
In accordance with the Copyright Modernization Act, unless otherwise Indicated in writing, copyright of the works supplied to you remains the property of Sky Sight Aerial Solutions Inc.. The sales representative, broker, or private owner (the Client) who retains us for this service has permission to use images and other works supplied on any electronic or printed form of advertisement for the promotion of that property. The images and other works may also be used by the Client’s parent company for the sole purpose of marketing the specific property photographed. Ownership of the images and other supplied works remain with Sky Sight, and licence is granted only to the Client and Client’s parent company (example: the client’s brokerage), and not to any third party. Any usage of the images or other works by a third party is strictly prohibited unless approved in writing by Sky Sight. The licensing agreement is valid only for the duration the home/property is listed for sale and cannot be reused without specific written permission. Builders, stagers, designers and others who wish to use images taken by our photographer should contact us for specific licensing information. Images and other works cannot be sold to another agent who takes over an expired or withdrawn listing. Failure to pay for the images or other works will result in a copyright infringement/violation. You will be asked to remove the image from any electronic or printed form of advertisement. Failure to stop using them will result in legal action.
CANCELLATION, RE-SCHEDULING, NO-SHOW, AND INCLEMENT WEATHER POLICY
If cancellation or rescheduling is necessary, please do so with a minimum of 24 hours notice. Any shoot cancelled or rescheduled within less than 24 hours but greater than 2 hours of the start of the booking appointment is subject to a fee of 50% of the total rate for the booking. Any shoot cancelled or rescheduled within 2 hours of the start of the booking appointment will be subject to a fee of 100% of the total rate for the booking. Unless otherwise agreed upon, arriving late beyond 30 minutes to an appointment, not providing a lockbox code, or otherwise not providing access to the property for the shoot for the duration of the booking time, will be considered a cancellation, and will be subject to a fee of 100% of the total rate for the booking. Every effort will be made to accommodate a re-scheduling. In the event of inclement weather, preventing photography, videography, drone flight, or other services from being completed, a new date will be scheduled at the earliest available time, at no extra cost. Sky Sight Aerial Solutions Inc. shall solely determine what constitutes inclement weather that is significant enough to require re-scheduling. In the event of significant overcast weather (i.e. on gloomy days), we may continue to provide our media services, however, we will provide complementary digital sky replacement for one or more exterior photographs, as deemed appropriate by the photographer.
READINESS POLICY
The Client is responsible for ensuring that the property is completely ready to be photographed before the arrival of our team. If the property is not ready to be photographed and our team is required to wait on-site, the wait time will be charged at a rate of $150 per hour. All areas and rooms of the property should be completely prepared for the shoot (we highly recommend contracting a professional staging company for best quality results) and once our team starts, we ask that no furniture or items be moved (including between rooms). Due to safety and liability reasons, Sky Sight Aerial Solutions Inc. employees will not move, clean or prepare, or assist in moving, cleaning, or preparing, any furniture or other items at the property. Once the shoot has been started, our team will photograph the property as is. If the property is determined to be unprepared, the client can decide to reschedule the shoot, in which case a fee of 100% of the total rate for the booking will apply. To help prepare for your shoot, please refer to our helpful preparation guide. In order to complete the project in the most efficient manner and to provide the best possible results, we ask that a maximum of 1 person be present at the property during the booking time (this can be either the realtor or the owner, not both). Please note, that during the shoot, we may ask that the person at the property to wait outside the property or to wait in an area of the property not being actively photographed by our team. If the person at the property is not cooperative (for example, in the case of tenants), our team may choose to terminate the shoot, and in this case a fee of 100% of the total rate for the booking will apply. Sky Sight Aerial Solutions Inc. employees will under no circumstances tolerate any disrespectful or abusive language or actions.
DRONE OPERATIONS POLICY
Aerial photography and videography services may be provided using Remotely Piloted Aircraft Systems (RPAS). RPAS operated by Sky Sight Aerial Solutions Inc. are registered with Transport Canada and are subject to Transport Canada regulations. Our team members are licensed to operate RPAS, and will only do so when it is deemed safe. When booking any media service, the Client authorises Sky Sight Aerial Solutions Inc. and its employees to operate one or more RPAS in accordance with Canadian regulations on or above the property at the address specified at the time of booking. The Client certifies that they have the authority, or have acquired the authority from the owner of the property, to authorise Sky Sight Aerial Solutions Inc. and its employees to operate on or above the property at the address specified at the time of booking. All RPAS flights shall be with consideration and subject to: weather, equipment limitations, safety of bystanders and property, Transport Canada regulations, and other restrictions. Sky Sight Aerial Solutions Inc. cannot guarantee that a RPAS flight will always be possible at the location of the shoot, although every effort will be made to accommodate aerial photography and videography shooting.
SAFETY POLICY
The Client certifies that there are no reasonable hazards at the property specified at the address at the time of booking that might cause injury or harm to any employee of Sky Sight Aerial Solutions Inc. during the course of their work. The Client certifies that the property is kept clean, at a comfortable climate, free of strong odours, free of allergens, in addition to being free of any obstacles, tripping, and slipping hazards. All Sky Sight Aerial Solutions Inc. must have a safe and comfortable working environment. If our team member(s) deem the property to be unsafe, hazardous, or otherwise an uncomfortable working environment, the team member(s) will leave the premises and the shoot will be subject to a fee of 100% of the total rate for the booking.
PRIVACY POLICY
The Client authorises Sky Sight Aerial Solutions Inc. to photograph the property at the address specified at the time of booking. The Client authorises Sky Sight Aerial Solutions Inc. to publish the photographs, including any and all identifiable objects or belongings that may present at the property. Client certifies that they have the authority, or have acquired the authority from the owner of the property, to authorise Sky Sight Aerial Solutions Inc. to photograph the property and publish photographs of the property (including any identifiable objects or belongings that may be present at the property). If there are tenants living at the property, the client, or the owner of the property, must have received written consent in advance from the tenants to authorise Sky Sight Aerial Solutions Inc. to photograph any identifiable objects of belongings that may be present at the property. The Client certifies that, upon request, they will provide Sky Sight Aerial Solutions Inc. a copy of written permission(s) from one or more tenants living at the property. The Client and/or the owner(s) of the property assume full liability for any legal action taken by any tenants pertaining to photography of private or identifiable items at the property by Sky Sight Aerial Solutions Inc. If the Client and/or the owner(s) or tenant(s) of the property wish to not have personal belongings photographed, they must ensure that those belongings are put in an area where they will not be visible (i.e. draws, cabinets, or off-site storage) in advance of the shoot.
PAYMENT POLICY
Will be invoiced after the booking on a NET 7 schedule (payment due within 7 days after the invoice is sent). Payment can be made online through our payment processing provider via credit card, debit card, or via e-transfer to: Sky Sight Aerial Solutions Inc. at info@skysight.ca. Invoices paid late, will be subject to a late payment fee of 1.5% per 30 days.
